This Acceptable Use Policy (the "AUP") explains what you can and cannot do with our proxy network, dedicated servers, and related infrastructure. Lawful, high-volume automation is permitted — web scraping, data collection, price and ad monitoring, market research, and retail bots are all allowed when you act lawfully. You are solely responsible for your own traffic, your targets, and your compliance with the law, and serious or unlawful misuse can lead to suspension, termination, forfeiture of your balance, and reporting to authorities.
1Overview and Scope
This Acceptable Use Policy governs your access to and use of the proxy services (residential, mobile, and ISP proxies), dedicated servers, and all related infrastructure, software, and tools (collectively, the "Service") provided by Soni's World LLC ("Soni's World", "ResiFactory", "we", "us", or "our"), a New York limited liability company doing business as ResiFactory, operating at resifactory.net.
This AUP is incorporated by reference into, and forms part of, our Terms of Service. It supplements, and does not replace, the Terms of Service. Capitalized terms used but not defined here have the meanings given in the Terms of Service. If there is a direct conflict between this AUP and the Terms of Service regarding permitted and prohibited use, this AUP controls.
This AUP applies to every user of the Service and to all traffic, requests, sessions, connections, and data that pass through our network or infrastructure, regardless of where you are located or where your targets are located. You access the Service from around the world, and this AUP applies to you no matter your jurisdiction. By creating an account, adding funds, or sending any traffic through the Service, you agree to this AUP. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, and "you" includes that organization.
2Your Responsibilities
You are solely and fully responsible for everything you do through the Service, including all traffic you generate, the targets you connect to, the data you collect, and the manner in which you use that data. We provide network capacity and infrastructure; we do not direct, supervise, or endorse how you use it.
By using the Service, you agree and represent that:
- You will use the Service only for lawful purposes and in compliance with all laws, regulations, and rules that apply to you, to your activity, and to your targets, including the laws of the State of New York and the United States, and the laws of any jurisdiction from which you operate or that you target.
- You are responsible for assessing and bearing the risk of the terms of service, acceptable use policies, robots directives, rate limits, and other rules of every website, application, API, or service you access through the Service. Any dispute between you and a target is solely between you and that target, and it is your obligation to resolve it. Nothing in this AUP makes adherence to a target's own terms an independent obligation to us; your obligation to us is to act lawfully and within your authority.
- You have all rights, licenses, consents, and authorizations necessary to send your traffic, access your targets, and collect, process, and use any data you obtain through the Service, including where personal data, intellectual property, or contractual restrictions are involved.
- You, and anyone using your account, are not on, owned or controlled by, or acting for or on behalf of any party on, any U.S. or other applicable sanctions, embargo, or restricted-party list, and you are not located in or ordinarily resident in any embargoed or comprehensively sanctioned jurisdiction.
- You will keep your account credentials secure, maintain accurate account and billing information, and remain responsible for all activity conducted through your account, including activity by anyone you allow to use it.
- You will not rely on us for legal advice. Whether a particular use is lawful is your determination to make, with your own counsel where appropriate.
You agree to defend, indemnify, and hold us harmless from claims arising out of your use of the Service in breach of this AUP, as further described in the Terms of Service.
3Permitted Use
The Service is built for legitimate, large-scale, automated use of the internet. We expressly permit, and our business is designed to support, lawful high-volume and automated activity, including:
- Web scraping, crawling, and automated data collection from publicly available sources.
- Price monitoring, inventory and availability tracking, and competitive and market research.
- Advertising verification, brand-protection monitoring, and detection of ad fraud or affiliate fraud.
- Search-engine results monitoring, SEO research, and rank tracking.
- Sneaker, retail, and other purchasing or checkout automation (commonly called "bots") used to buy goods and services.
- Account management automation, social-media management, and quality-assurance or geo-testing of your own or authorized properties.
- Application testing, content delivery verification, and accessing geographically restricted content that you are entitled to access.
These uses are permitted only when conducted lawfully. The fact that an activity is automated or high-volume does not, by itself, violate this AUP. What matters is whether the activity is lawful and whether you are authorized to do it. You bear full responsibility for ensuring that your specific use is permitted under applicable law; we do not pre-approve, review, or vouch for any particular use case.
4Prohibited Activities
You may not use the Service, and may not permit anyone using your account to use the Service, for any of the following. This list is illustrative, not exhaustive.
Unlawful Activity
- Any activity that violates applicable law, regulation, or court order, or that facilitates or promotes such activity, regardless of where you or your target are located.
Unauthorized Access and Attacks
- Unauthorized access to, or interference with, any system, network, account, device, or data, including hacking, credential stuffing, password spraying, brute-forcing, session hijacking, or exploiting vulnerabilities, against any system you do not own or are not expressly authorized in writing to access or test.
- Denial-of-service or distributed denial-of-service attacks, flooding, traffic amplification, or load or stress testing of third-party systems without authorization.
- Probing, scanning, or testing the vulnerability of any system or network without authorization, or breaching or circumventing any security or authentication measure.
Fraud and Financial Crime
- Fraud of any kind, including phishing, pharming, spoofing, social engineering, carding, payment or transaction fraud, click or impression fraud, refund or chargeback fraud, identity theft, account takeover, or the creation or use of fraudulent or stolen accounts, identities, or payment instruments.
Payment Disputes and Chargebacks
- Filing a chargeback, payment reversal, or other payment dispute for charges you actually incurred — including bandwidth (in gigabytes) and dedicated-server charges metered by our systems — instead of first contacting [email protected] to resolve the matter. Initiating such a dispute is a breach of this AUP. We may suspend or terminate your account, forfeit your remaining account balance, and decline future service, and you remain liable for the disputed amounts and any associated fees, as further described in the Terms of Service and Refund Policy.
Malicious Code and Infrastructure
- Creating, hosting, distributing, or transmitting malware, ransomware, spyware, worms, trojans, rootkits, keyloggers, or other harmful code.
- Operating, controlling, or relaying traffic for botnets or command-and-control infrastructure, or using the Service as a node in any such system.
Abusive Messaging
- Sending spam, unsolicited bulk or commercial messages, or any messaging that violates anti-spam, telemarketing, or electronic-communications laws.
Child Sexual Abuse Material — Zero Tolerance
- Any access to, creation of, storage of, transmission of, or facilitation of child sexual abuse material (CSAM) or any content or conduct that sexually exploits or endangers minors. We have zero tolerance. We will terminate offending accounts immediately, preserve relevant records, and report to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement.
Harm to People
- Harassment, stalking, doxxing, threats, incitement of violence, intimidation, or hateful conduct directed at any person or group.
Intellectual Property and Counterfeiting
- Infringing the copyrights, trademarks, patents, trade secrets, or other intellectual property or proprietary rights of others; software, media, or content piracy; or trafficking in counterfeit, pirated, or unlawfully obtained goods.
Sanctions and Export Controls
- Any use that violates economic sanctions, trade restrictions, or export-control laws, including use by, on behalf of, or for the benefit of sanctioned or restricted parties, or use originating from or targeting embargoed or comprehensively sanctioned jurisdictions.
Harm to Our Network
- Interfering with, overloading, attacking, disrupting, reverse-engineering, decompiling, or attempting to circumvent the limits, controls, authentication, or protections of our network or infrastructure, or attempting to gain unauthorized access to any part of the Service or to other users' data.
Account, Resale, and Promotion Abuse
- Reselling, sublicensing, redistributing, or otherwise making the Service available to third parties without our prior written authorization.
- Sharing, selling, or transferring your account or credentials, or allowing unauthorized parties to use your access.
- Abusing, manipulating, or exploiting free credits, trials, referral programs, promotions, or pricing, including creating multiple or fake accounts to obtain benefits.
5Identity Verification and Sanctions Screening
To keep the Service secure and to comply with the law — including economic-sanctions, anti-fraud, and anti-money-laundering requirements — we reserve the right to verify who our customers are before, during, or after providing the Service.
- You represent and warrant that you, and anyone using your account, are not a sanctioned, blocked, or restricted party, are not owned or controlled by or acting for such a party, and are not located in or ordinarily resident in any embargoed or comprehensively sanctioned jurisdiction.
- We may, at our discretion, require you to provide identity, business, billing, or beneficial-ownership information, and we may screen you, your account, your payment instruments, and your traffic against applicable sanctions, watch, and restricted-party lists.
- We may suspend, restrict, decline, or terminate service, and may decline to onboard or continue an account, where you do not complete requested verification, where verification fails, or where we reasonably suspect a sanctions, fraud, money-laundering, or AUP risk.
Information we collect for verification is handled in accordance with our Privacy Policy. These measures are in addition to, and do not limit, the enforcement actions described below.
6Network and Fair Use
Our network is a shared resource. You must use it in a way that does not unfairly harm other users or the integrity, performance, or availability of our infrastructure.
- Do not engage in activity that disproportionately or unreasonably degrades, congests, or destabilizes the network, including abnormal connection rates, excessive concurrent sessions, or traffic patterns that we reasonably determine to be abusive or harmful to other users.
- Respect all technical limits, including bandwidth allotments, rate limits, concurrency limits, session controls, and any per-product or per-plan constraints. Do not attempt to evade, disable, or work around these limits.
- Use bandwidth (measured in gigabytes) and dedicated server capacity for their intended purpose. Do not attempt to use the Service in a manner designed to extract capacity beyond what your usage and balance support.
- Do not resell, sublicense, or sub-distribute access to the network without our prior written authorization. Pay-as-you-go account credit and dedicated servers are licensed to you for your own use as described in the Terms of Service.
Usage Metering
Bandwidth and dedicated-server usage are measured by our systems. Our usage records are the authoritative basis for deducting your account credit and for any billing under the Service, absent manifest error. You are responsible for monitoring your own consumption. Billing mechanics, including how account credit is applied, are described in the Terms of Service and Refund Policy.
Availability
The Service, including specific IPs, locations, pools, and dedicated servers, is provided on an as-available basis. This AUP does not create any service-level, uptime, throughput, or availability guarantee; any such commitments, if offered, appear only in the Terms of Service.
We may apply reasonable technical measures — such as throttling, rate limiting, or temporary restriction — to protect the network and preserve fair access for all users. These measures are protective, not punitive, and are separate from the enforcement actions described below.
7Security Testing and Vulnerability Disclosure
You may not conduct security testing of any kind — including scanning, penetration testing, fuzzing, or exploitation — against systems you do not own or are not expressly authorized in writing to test. This applies both to third-party targets and to our own Service: do not test, probe, or attack our network, infrastructure, websites, or systems without our prior written permission.
We welcome responsible disclosure of genuine security vulnerabilities in our own systems. If you believe you have found a vulnerability affecting the Service, please:
- Report it promptly to [email protected] with enough detail for us to reproduce and assess the issue (affected component, steps, and any proof of concept).
- Limit your testing to the minimum necessary to demonstrate the issue, and stop as soon as you confirm a vulnerability exists.
- Avoid accessing, modifying, deleting, or exfiltrating data that is not your own, and avoid degrading or disrupting the Service or other users.
- Give us a reasonable opportunity to investigate and remediate before any public disclosure, and do not exploit the vulnerability beyond what is needed to report it.
If you act in good faith, comply with this section, and do not harm us, our users, or third parties, we will not pursue action against you for that good-faith research. This section is not a bug-bounty offer and does not promise any reward.
8Monitoring and Enforcement
We respect the confidentiality of your activity and we do not routinely inspect the content of customer traffic. However, to operate the Service we log and retain connection and usage metadata — such as bandwidth consumed (in gigabytes), session and connection records, timestamps, authentication events, and related technical data — for accounting and billing, security, fraud and abuse prevention, capacity planning, and legal compliance. How we handle this data is described in our Privacy Policy.
The Service routes network traffic; it is not an end-to-end encryption, anonymity, or confidentiality product, and you must not rely on it as one. You are responsible for securing your own traffic and any sensitive data, including by using your own encryption where appropriate. We may investigate suspected violations of this AUP, including by reviewing metadata, correlating activity, and, where lawfully required or necessary to address an active threat or a credible abuse report, examining relevant traffic to the extent reasonably needed. We are not obligated to monitor use of the Service, but we reserve the right to do so.
If we determine, in our reasonable discretion, that you have violated this AUP, or to protect the Service, our users, or third parties, we may take any one or more of the following actions, with or without prior notice depending on the severity and urgency of the violation:
- Issue a warning or request that you stop the offending activity.
- Throttle, rate-limit, or restrict your access or specific traffic.
- Suspend or terminate your account, sessions, or specific products or servers.
- Remove or disable access to offending configurations or content.
- For serious, repeated, fraudulent, or unlawful violations, forfeit your remaining account balance and decline refunds, as permitted under the Terms of Service and Refund Policy.
- Preserve relevant records and report the activity to, and cooperate with, law enforcement and other authorities, and disclose information as required by law or valid legal process.
The severity of our response will generally reflect the severity of the violation. The most serious categories — including CSAM, fraud, attacks on systems, and sanctions violations — may result in immediate termination without warning. Our decision not to enforce any provision of this AUP in a given instance does not waive our right to enforce it later.
9Reporting Abuse
If you believe that traffic from our network or any use of the Service violates this AUP or harms you or others, please report it to us so we can investigate.
- Send abuse reports and legal notices to [email protected]. This is also the address for law-enforcement requests.
- Send intellectual-property and copyright (DMCA-style) infringement notices to [email protected]. We respond to valid notices, may remove or disable access to offending configurations or content, and may terminate the accounts of repeat infringers. The notice procedure in the Terms of Service applies.
- Include as much detail as you can: the nature of the abuse, the affected systems or accounts, relevant timestamps with time zone, IP addresses, log excerpts, sample requests or messages, and any other evidence that will help us identify and act on the issue.
- We review abuse reports promptly and take appropriate action under the Monitoring and Enforcement section above. Because we present a single first-party network, providing precise timestamps and source detail materially improves our ability to trace and stop abuse.
For account, billing, and refund matters, contact [email protected]. For data-protection and privacy requests, contact [email protected]. We will not retaliate against good-faith reporters, and we may follow up with you for additional information as needed.
10General
The following terms support the enforceability of this AUP:
- Severability. If any provision of this AUP is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
- Survival. Provisions that by their nature should survive termination — including those concerning your responsibilities, indemnification, intellectual property, liability for incurred charges, and our enforcement and disclosure rights — survive any suspension or termination of your account or of the Service.
- No waiver. Our failure to enforce any provision of this AUP in a given instance is not a waiver of our right to enforce it later.
- Relationship to other terms. This AUP supplements, and does not replace, the Terms of Service. Other obligations and remedies set out in the Terms of Service continue to apply.
11Changes to This Policy
We may update this AUP from time to time to reflect changes in our Service, our network, applicable law, or the threats and abuse patterns we encounter. When we make changes, we will revise the "Last updated" date below and post the current version at resifactory.net/acceptable-use.
If we make material changes, we will provide reasonable notice through the Service, by email, or via Discord before those changes take effect, except where an immediate change is needed to address legal requirements, security risks, or active abuse. Your continued use of the Service after an update becomes effective constitutes your acceptance of the revised AUP. If you do not agree to the changes, you must stop using the Service. We encourage you to review this AUP periodically.
